Terms of Service

These Terms govern your use of evacmaker.com and the EvacMaker software and services (the "Service"), operated by Jianwei Li ("we", "us"). By using the Service, you agree to these Terms.
The Service
EvacMaker is a browser tool that helps you draw evacuation plans: Flucht- und Rettungspläne laid out after DIN ISO 23601 for Germany, Austria and Switzerland, and 避難経路図 (evacuation route maps) for Japan. You upload a floor plan, mark exits and equipment, and the Service suggests escape routes and builds the sheet (title bar, legend, rule texts, stamp block) from a template.
Drafts and a watermarked preview are free. Exporting a plan without watermark uses points ("Planpunkte" / プランポイント) bought in one-time packs, or is included in the monthly Sifa subscription. The current prices are on the pricing page.
Your responsibility for the plan
EvacMaker assists you. It does not certify, approve or inspect anything.
- You decide where the exits, stairs, extinguishers and other equipment are. The Service never decides this on its own.
- Routes drawn by the Service are suggestions. You check and confirm them.
- Before every export you confirm that you have checked exits, routes and the you-are-here point on site. We record the time of that confirmation.
- The rule check compares the sheet with public design rules (for Germany: ASR A1.3, ASR A2.3 and public summaries of DIN ISO 23601; for Japan: the minpaku law, its guideline and published fire-department examples). It can be incomplete or out of date, and local authorities can require more. "Laid out after DIN ISO 23601" describes the layout. It is not a certificate or a guarantee that an authority, insurer or inspector accepts the plan.
- You are responsible for hanging the right plan in the right place and keeping it up to date, and for any other duties under the law that applies to your building (for example workplace, building or fire-prevention rules).
Accounts and Acceptable Use
You can draft without an account. Exporting needs an account. You are responsible for your account and for keeping your credentials secure. You agree not to misuse the Service, including attempting to disrupt it, access it without authorization, reverse-engineer it, or use it for anything unlawful, fraudulent, or harmful.
Your Content
You keep ownership of the floor plans and other content you put into the Service. You grant us a limited license to host, process, and display that content only as needed to provide the Service to you. You are responsible for having the rights to the floor plans you upload. Plans you export are yours to print, hang and share.
Automated and AI Features
Some features (for example automatic routes, reading walls from a PDF, or the "Beta" auto-draft for photos) are automated. Their output can be wrong or incomplete. Review it before relying on it.
Points, Packs and Subscriptions
- Prices. In Germany we show the price including 19 % VAT and the net price for businesses; Waffo calculates the exact tax for your country at checkout. Japanese prices include consumption tax.
- Packs are one-time payments. Points have no expiry date, no cash value and are not transferable.
- The first export of a sheet uses the points shown on the pricing page. Another mounting location of the same floor uses fewer points. Edits and new exports of a sheet you have already paid for are free.
- The Sifa subscription is billed monthly in advance until cancelled. You can cancel at any time in Settings → Billing. Cancellation takes effect at the end of the current billing period.
- Sale and payment are handled by our payment provider Waffo as Merchant of Record, which acts as the seller of record and handles billing, taxes, receipts, refunds and payment disputes. Refunds are handled as described in our Refund Policy. If a payment is refunded, the points from it are removed.
- We may change prices for future purchases. Points you already bought keep their value.
Intellectual Property
We own the Service, including its software, templates and design. Safety signs shown in
the Service come from public-domain or CC0 sources, listed in /symbols/provenance.json.
We grant you a limited, non-exclusive, non-transferable right to use the Service under
these Terms.
Warranties
We provide the Service with reasonable care and skill. Beyond that, and to the extent the law allows, the Service is provided "as is" without further warranties. We do not warrant that the Service will be uninterrupted or error-free. Statutory rights that cannot be excluded (for example consumer rights in the EU or Japan) are not affected.
Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for intent or gross negligence, under mandatory product liability law (for example the German Produkthaftungsgesetz), or for any other liability that cannot be limited or excluded by law.
Subject to the paragraph above, we are not liable for indirect or consequential damages, or for loss of data, profits or revenue, and our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or EUR 100. For slight negligence we are only liable for breach of essential contractual obligations, limited to the damage typical for this kind of contract.
Indemnification
You agree to indemnify Jianwei Li against third-party claims arising from content you upload without the right to do so, or from your breach of these Terms.
Termination
We may suspend or terminate access if you violate these Terms. You may stop using the Service and delete your account at any time. Unused points are not refunded on deletion unless the Refund Policy or the law says otherwise.
Governing Law
These Terms are governed by the laws of [GOVERNING LAW – TODO(owner); site.config currently says “Delaware”], without regard to its conflict-of-laws rules. If you are a consumer, you keep the protection of the mandatory consumer law of the country where you live. If any provision is found unenforceable, the remaining provisions stay in effect.
Changes
We may update these Terms from time to time. We will tell you about material changes before they apply. The date above shows the current version.
